Provider grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license for one natural person to use the software for lawful purposes, strictly in accordance with the documentation and these terms.
The software is licensed, not sold. Provider and its licensors retain all rights, title, and interest, including all intellectual property rights.
Provider may change, suspend, or discontinue any feature, update, or service at any time, with or without notice, and has no obligation to provide maintenance, support, or future compatibility.
All purchases and fees are final. No refunds, credits, or partial reimbursements are owed for any reason, including non-use, reduced use, dissatisfaction, feature changes, suspension, or termination, to the fullest extent permitted by law.
The software is provided "as is" and "as available", with all faults and without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, security, uninterrupted availability, or error-free operation.
To the fullest extent permitted by law, Provider is not liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenue, data, goodwill, or business interruption.
Provider's total aggregate liability arising out of or related to the software will not exceed the amount you actually paid to Provider for the software license in the twelve (12) months before the event giving rise to the claim.
You will defend, indemnify, and hold harmless Provider and its directors, officers, employees, and affiliates from and against all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or related to your use of the software, violation of these terms, or violation of any law or third-party right.
These terms apply until terminated. Provider may suspend or terminate your license immediately at its sole discretion, with or without notice, for any reason. Upon termination, you must stop using and delete all copies of the software.
These terms are governed by the laws of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Exclusive venue for all disputes is Freiburg im Breisgau, Germany, to the extent permitted by law.
Provider may modify these terms at any time. Updated terms become effective upon publication. Continued use of the software after publication constitutes acceptance of the updated terms.
